Scope of Trademarks That Can Be Registered

Following amendments under the WTO-related provisions, a trademark may be any sign that is visually perceptible and can be represented graphically. In particular, it may be composed of a combination of text, personal names/names, letters, numbers, graphical elements, and colours, including any combination of the foregoing elements.

Three-Dimensional Trademarks

A trademark may include a three-dimensional form, but it must be recordable and publishable—for example, in the form of drawings or a textual description.

Increasing the Chances of Registration Success

To increase the chances of successful registration, it is recommended that the customer provides a trademark design created by themselves wherever possible, and that the wording-level meaning is not particularly obvious. At the same time, ensure the trademark is distinctive and novel.

1.Confirm the trademark type to be applied for (word mark / device mark / word-and-device combination / three-dimensional, etc.).

2.Select the appropriate class(es): Choose the correct class(es) based on the scope of the goods or services (as mapped in the classification table).

3.Search for similar trademarks and conduct a risk assessment: Compare with existing trademarks to reduce the risk of refusal due to similarity or infringement of others’ rights.

4.Applicant information: Provide basic details of the applicant/company, including name and address, etc.

**5.**Trademark design submission: Submit the trademark design/wording. If it is a device or a combined mark, provide a clear design or image file.

**6.**List of goods or services: Specify the goods or services to be covered, and ensure they match the selected class(es).
